Terms of Service

Please read these Terms carefully before using Vivimate. By using our service, you agree to be bound by these Terms.
1. Acceptance of These Terms
These Terms of Service form a binding legal agreement between you and Vivimate OÜ (registered in Estonia under company number 16289437, registered office Vivimate OÜ, Lõõtsa tn 8, 11415 Tallinn, Estonia), trading as Vivimate.
By creating an account, starting a trial, paying for a subscription, or using vivimate.io, panel.vivimate.io, or any related service, you confirm that you have read these Terms, understood them, and agree to be bound by them.
If you are entering into these Terms on behalf of a company or other legal entity, you confirm that you have authority to bind that entity. If you do not have authority, or you do not agree to these Terms, you must not use the service.
You must be at least 18 years old, or the age of majority in your jurisdiction, to buy a subscription. If you are under 18 but have reached the age of digital consent in your country, you may only use the service with the involvement of a parent or guardian who agrees to these Terms on your behalf.
2. The Service
Vivimate is a licensed IPTV reseller. We provide:
- ●Reach into a curated linear-TV library carried over IP from upstream content partners
- ●An on-demand library of films plus series
- ●Programme-guide data (EPG) covering every channel on the line-up
- ●Connection credentials (Xtream Codes username and password, alongside an M3U playlist URL) used to authenticate against our origin servers from any compatible IPTV player application (Hot Player Pro, BOB Player Pro, Set IPTV, XCIPTV, IBO Player Pro, IPTV Smarters Pro, TiviMate plus comparable apps)
We do not provide the player applications themselves, and we do not warrant any third-party application. We do not host or own the underlying broadcast content; we resell licensed access to it under agreements with our upstream providers.
The channel line-up, VOD library, picture quality, and bitrate are subject to change at any time, including for content licensing reasons outside our control.
3. Your Account
To use the service you must create an account by giving accurate, current, and complete information.
You are responsible for:
- ●Keeping your username, password, and Xtream credentials confidential
- ●Every action that takes place under your account, whether you authorised it or not
- ●Telling us immediately at [email protected] or +1 (939) 699-3536 if you suspect unauthorised access
- ●Keeping the email address on your account up to date so we can reach you
Your subscription is licensed to you personally for non-commercial home use. You may not:
- ●Share, lend, resell, sublicense, or transfer your credentials to anyone else
- ●Use the same credentials from more devices simultaneously than your plan allows
- ●Display Vivimate content in a public place (bar, gym, hotel lobby, school, hospital waiting room, place of worship)
- ●Use the service to operate a commercial streaming or hosting business
We reserve the right to monitor for and suspend accounts that breach this section. Where we reasonably believe credentials are being shared or resold, we may revoke them without refund.
4. Subscriptions, Pricing, and Payment
Plans
We offer prepaid plans of 1, 3, 6, and 12 months, each available with 1, 2, 3, or 4 simultaneous-stream entitlements. The plan you choose at checkout is the plan you receive.
Prices
All prices are in US Dollars (USD) and are inclusive of any taxes due in our country of establishment. Where local consumption tax (VAT, sales tax, GST, IVA) applies in your country of residence, the price displayed may include it or may have it added at checkout, depending on the applicable rules.
No auto-renewal
Subscriptions do not renew automatically. Your card is charged once for the period you choose. When that period ends, access stops until you manually start a new period. We will email a reminder shortly before expiry.
Payment methods
We accept major credit and debit cards (Visa, Mastercard, American Express) and PayPal. Card data is processed by Stripe and never stored on our servers. We may add or remove payment methods at any time.
Activation
Once payment clears, your credentials are emailed to you, normally within 60 seconds. If you have not received them after 10 minutes, check your spam folder and then contact [email protected].
Price changes
We may change prices for new orders at any time. Anyone with an active subscription keeps the price they paid for the term they paid for. We will give at least 30 days' notice by email before a price change affects renewals.
Currency and bank fees
If your card or PayPal account is denominated in a currency other than USD, your bank or PayPal may apply a conversion rate or fee. That charge is between you and your bank and is not refundable by us.
5. Acceptable Use
When you use the service you agree not to:
- ●Share, sell, or otherwise distribute your credentials, or attempt to do so
- ●Run more concurrent streams than your plan entitles you to
- ●Use the service in a public, commercial, or broadcast setting
- ●Use bots, scripts, scrapers, or any automated means to access the service or its data
- ●Reverse-engineer, decompile, disassemble, or otherwise attempt to extract the source code, server URLs, or business logic of any part of the Vivimate infrastructure
- ●Circumvent, disable, or interfere with any security, geofencing, or rate-limiting feature
- ●Use the service for, or in connection with, any unlawful content or activity
- ●Access the service from any country where either IPTV reception itself or the underlying broadcast content is legally restricted (it is on you to know plus obey the law in the location you connect from)
- ●Resell, white-label, or otherwise commercialise the service or any part of it without our written agreement
If we reasonably believe you are in breach of this section we may, without prior notice, throttle, suspend, or terminate your access. Serious or repeated breaches may result in termination without refund.
6. Intellectual Property
The Vivimate name, logo, the site design at vivimate.io, our customer panel design at panel.vivimate.io, the copy on this site, our setup guides, and our support knowledge base are protected by copyright, trademark, and other intellectual property rights. They are owned by Vivimate OÜ or our licensors. Nothing in these Terms transfers any of those rights to you.
The television channels, films, series, and other content delivered through the service are owned by their respective rights holders. We are a licensed reseller of access to that content. You receive a personal, non-exclusive, non-transferable, revocable, royalty-free licence to view that content for non-commercial purposes within your household for the duration of your active subscription, and for no longer.
You may not record, capture, restream, transcode, post, publish, distribute, modify, or create derivative works of any content received through the service without the rights holder's express permission.
7. Service Availability
We target 99.9% monthly uptime measured at the edge. We do not guarantee uninterrupted, error-free service. Outages can happen because of:
- ●Scheduled maintenance (we try to perform this during low-traffic windows and notify in advance where practical)
- ●Unscheduled infrastructure incidents at our hosts, our upstream providers, or our CDN partners
- ●Disruptions to the public internet between you and us
- ●Force majeure (natural disasters, war, terrorism, government action, large-scale outages of essential utilities)
- ●Action you take on your home network (Wi-Fi, ISP throttling, VPN, firewall) that we cannot control
If the service is unavailable on our side for more than 24 consecutive hours we will, on request, extend your subscription by the lost period at no cost. If the outage exceeds 7 consecutive days we will, at your option, extend the term or refund the unused part of your subscription pro-rata.
We do not credit or refund outages caused by your own network, your IPTV player, your device, your ISP, or a VPN you choose to use.
8. Trials, Refunds, and Cancellation
We offer a 14-day money-back guarantee on paid subscriptions, subject to the eligibility rules in our Refund Policy at vivimate.io/refund. After 14 days from the date of purchase, the subscription is non-refundable.
The 1-month plan and any 1-day trial period are non-refundable. The full Refund Policy explains what does and does not qualify, and how to submit a request.
You do not need to cancel anything to stop the service. Because subscriptions do not auto-renew, doing nothing at the end of the term ends the service. To request a refund, email [email protected] or call +1 (939) 699-3536 within the 14-day window and reference your order number.
EU and UK consumers, right of withdrawal
If you are a consumer in the EU or UK you would normally have a 14-day right of withdrawal for digital services under the Consumer Rights Directive (2011/83/EU) and the UK Consumer Contracts Regulations 2013. By starting to use the service (downloading your credentials and connecting a player) within the 14-day window, you expressly consent to immediate performance and acknowledge that you lose the right of withdrawal for the part of the service already supplied. The Refund Policy applies after that point.
9. Geographic Use and Sanctions
The service is technically reachable from most countries with an internet connection. You are responsible for ensuring your use complies with the laws of the country you connect from. The service may not be lawfully used in every jurisdiction; if local law restricts or prohibits IPTV reception, you must not use the service.
We do not knowingly sell to, or operate in, jurisdictions under EU or US sanctions, including but not limited to North Korea, Iran, Syria, Cuba, the Russian Federation, Belarus, and the non-government-controlled territories of Ukraine. If you are located in or ordinarily resident in any of these jurisdictions, you must not buy or use the service.
Some content in our line-up is geo-restricted by its rights holders. We are not responsible for content that becomes unavailable in your region for licensing reasons outside our control.
10. Limitation of Liability
Nothing in these Terms is intended to limit or exclude any responsibility we carry for the following:
- ●Personal injury (or death) arising directly from our negligence
- ●Fraud, or any fraudulent misrepresentation on our part
- ●Any other liability that cannot lawfully be excluded under the consumer-protection regime applicable to you
Subject to the paragraph immediately above, and as far as the law of your jurisdiction permits us to limit liability:
- ●Vivimate, its officers, directors, employees, contractors, agents, and licensors are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages
- ●We are not liable for loss of profits, revenue, business, goodwill, anticipated savings, or data
- ●We are not liable for downtime, picture-quality variations, content removed or restricted by rights holders, or any third-party action
- ●Our total aggregate liability arising out of or in connection with these Terms, the service, or your use of either, is capped at the amount you paid us in the 12 months immediately before the event giving rise to the claim
You agree that any claim must be brought within 12 months of the event that caused it, or it is permanently barred.
11. Disclaimer of Warranties
Beyond the explicit commitments laid out in these Terms, the service is supplied on a strict "as is" plus "as available" footing. So far as the law in your jurisdiction permits, we disclaim every warranty, condition or representation of every kind (whether spoken, written, implied or otherwise), spanning but in no way confined to:
- ●Implied warranties of merchantability, of fitness for any specific purpose, plus non-infringement
- ●Any guarantee that what we ship meets the specific use-case you have in mind
- ●A promise that the service stays up around the clock, runs on time, ships free of every defect, or remains uncompromised at all hours
- ●That the channels or VOD content available today will be available tomorrow
- ●That any information or recommendation in our setup guides, blog, or support replies is accurate, complete, or current at any given moment
12. Indemnity
You agree to indemnify and hold harmless Vivimate OÜ, its officers, directors, employees, and agents from any loss, claim, liability, damage, or expense (including reasonable legal fees) arising from:
- ●Your breach of these Terms
- ●Your misuse of the service
- ●Your violation of any law, regulation, or third-party right (including any rights-holder's copyright)
- ●Any content you transmit, upload, or send while using the service
We will tell you promptly of any claim covered by this indemnity, give you reasonable cooperation to defend it, and let you control the defence and any settlement, provided the settlement does not impose any obligation on us beyond payment.
13. Governing Law and Dispute Resolution
These Terms, and any non-contractual obligation arising out of them, are governed by the laws of the Republic of Estonia, without regard to its conflict-of-law rules.
Before starting any formal proceeding, you agree to contact us at [email protected] or +1 (939) 699-3536 and try to resolve the dispute informally. We will respond within 14 calendar days. Most disputes are resolved this way.
If informal resolution fails, the courts of Tallinn, Estonia, have exclusive jurisdiction, except that:
- ●If you are a consumer in the EU, you may also bring proceedings in the courts of your country of habitual residence, and you may use the EU's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr
- ●If you are a consumer in a US state with a small-claims court, you may bring an individual claim there
- ●Mandatory local consumer-protection law in your country always wins over this clause where it gives you more favourable rights
No class actions, class arbitrations, or representative actions are permitted.
14. Suspension and Termination
Access to the service can be paused or shut down by us at any moment, with or without prior warning, where we hold a reasonable belief that you have:
- ●Stepped outside these Terms, the Acceptable Use rules in section 5, or any other policy these Terms refer to
- ●Used the service in a manner that puts the platform at risk for other customers
- ●Run any form of payment fraud against us or our processors
- ●Created a legal, regulatory, or reputational liability for Vivimate
A termination triggered by breach forfeits unused subscription time and pays no refund. Where we end the relationship without cause, the unused portion of the running term is refunded on a pro-rata basis.
You can step away whenever. Because nothing renews automatically, leaving the term to expire is identical to cancellation.
Clauses whose nature requires survival (intellectual property, indemnity, limitation of liability, governing law) continue to bind after termination.
15. Force Majeure
We are not in breach of these Terms or liable for any delay or failure to perform if the cause is outside our reasonable control. This includes acts of God, war, terrorism, civil unrest, government action, change in law, pandemic, natural disaster, cyber-attack, large-scale outage of the public internet, failure of an essential third-party supplier, or strike.
16. Changes to These Terms
We may update these Terms from time to time. Where a change is material we will email active subscribers at least 14 days before it takes effect. The current version is always available at vivimate.io/terms with the "Last updated" date below the title.
Should the change not work for you, terminate your subscription ahead of the effective date. Continuing to use the service past that date counts as acceptance of the updated version.
17. Miscellaneous
Entire agreement
These Terms, together with the Privacy Policy, Refund Policy, and Cookie Policy referenced in them, are the entire agreement between you and Vivimate about the subject matter. They supersede every prior oral or written communication.
Severability
If any provision of these Terms is held invalid or unenforceable, the rest remain in full force.
Waiver
A failure or delay by us in enforcing any right under these Terms is not a waiver of that right.
Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign ours to an affiliate, or to any successor in connection with a merger, acquisition, or sale of all or substantially all of our business.
No partnership
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Vivimate.
Notices
We may give you notice by email to the address on your account, by an in-app message, or by a notice on the website. You may give us notice using the contact details in section 18.
